Terms of Transportation

Las Vegas Railway Express, also commonly known as X Train (hereinafter “X Train,” “we,” “us”) provides these Terms of Transportation which govern the relationship between X Train and you (the Site visitor and/or member) with respect to your use of X Train facilities including, train cars, stations, platforms, and any other pieces of property owned or managed by X Train or its affiliate, The National Railroad Passenger Corporation, also commonly known as Amtrak (hereinafter “Amtrak,”). It is important that you read carefully and understand the terms and conditions of this Agreement. By purchasing a ticket you are agreeing to the below Terms of Transportation

We reserve the right at any time to:

  • Change the terms and conditions of this Agreement;
  • Change any fees or charges for use of the Site.

Any changes we make will be effective immediately and automatically without further or special notice. Your continued use of the site and third party booking agents, following such changes will be deemed acceptance of such changes. Be sure to return to this page periodically to ensure familiarity with the most current version of this Agreement.

Transport of Passengers

Reservations must be made when required, and tickets are non-transferable. If you do not board your train as booked, your entire reservation will be considered canceled and no refund shall be issued. In order to ensure the quality of travel and safety and security of its passengers, X Train may refuse to transport Passengers:

 

  • Who have not paid the applicable fare;
  • Whose conduct is objectionable (such as, but not limited to, being under the influence of alcohol or narcotics);
  • Whose personal hygiene makes them offensive;
  • Who pose a health, safety or security hazard to other passengers or employees;
  • Who refuse to comply with safety or security rules or with instructions of Amtrak personnel;
  • Who would require on board personnel to provide personal care services or otherwise do not meet the essential requirements for the receipt of X Train services; or
  • Who refuse to consent to Amtrak security inspections of persons and/or baggage onboard Amtrak trains and/or at designated areas, such as train platforms and passenger boarding or waiting areas.

 

X Train employees or Amtrak employees or other authorized carrier representatives may remove such a passenger from the train at any inhabited place, as necessary under the circumstances, for any of the above reasons.

Seating

All seating is assigned unless stated otherwise. In the event you purchase dining room booth seating, all tables can sit 4 people and a party of 2 may be placed with another party of 2 at our election.

On board personnel will monitor seating of passengers to ensure compliance with the following policies:

  • Passengers are entitled to one seat per fare, to ensure other paying passengers are not excluded.
  • Seating is assigned in the event a train is put forth as a general admission run seating is on a first come – first served basis.
  • Seating arrangements will be made without regard to race, color, gender, creed, or national origin.
  • X Train reserves the right, whenever operating conditions require, to transfer passengers from one car or train to another en route.

Extra Space

For the safety and comfort of all customers those  who need extra space will be expected to purchase the seat conjoining at a full price fare in coach class. We encourage all customers to address all seating needs when booking. To book please call (855) 730-2040 or e-mail info@vegasxtrain.com.

Customers Traveling in Wheeled Mobility Devices

We welcome disabled or handicapped passengers. However, because these are older cars, there are no special handicapped facilities available.

Any traveler who intends to travel in a wheeled mobility device is encouraged to book as far in advance as possible. This is important because seating is limited. X Train may not be able to accommodate all customers traveling in a wheeled mobility device due to limited space.

Fares

All reserved seats will be assigned prior to date of departure.

The price of your travel will be the lowest fare available at the time you make your reservation.

Reasonable efforts will be made to ensure that all fares that are published are accurate and available for sale, but X Train reserves the right to correct any erroneously published fare that was not intended to be offered for sale. In the event that an erroneous fare is inadvertently published fore sale and a ticket is issued at the erroneous fare before it has been corrected, X Train reserves the right to cancel the ticket purchase and refund all amounts paid by the purchaser or, the purchaser’s option, to reissue the ticket for the correct fare.

Children’s Policy

  • One child (classified as an “infant”) under the age of 2 (0-23 months) may ride free with each fare-paying adult (age 18+) on adults lap.
  • Children are only permitted on coach and coach premium.
  • All other train cars are only 21+.

Animals on Board

We allow official trained service animals accompanying passengers with disabilities in all customer areas in our stations, and on select trains.

Trained service animals must be kept under the control of their owners or trainers at all times.

We permit no other animals on board at any time.

Force Majeure Event

X Train may, in the event of a force majeure event, without notice, cancel, terminate, divert, postpone or delay any train or the right of carriage without liability except to issue a refund. The refund will be made in the original form of payment in accordance with refund rules for any unused portion of the ticket.

Force Majeure Event means:

  • Any condition beyond X Train’s control including, but without limitation, meteorological conditions, acts of nature, riots, civil commotion, embargoes, wars, hostilities, or disturbances – actual, threatened, or reported. Also, because of any delay, demand, circumstances or requirement due, directly or indirectly to such conditions, or
  • Any strike, work stoppage, slowdown, lockout or any other labor related dispute involving or affecting X Train’s services, or
  • Any government regulation, demand or requirement, or
  • Any shortage of labor, fuel or facilities of X Train or others, or
  • Any fact not reasonably foreseen, anticipated or predicted by X Train.

Local Transportation Services at Third Party Stations

Information regarding local transportation services at third party service locations (including bus, taxi, trolley, and other local transportation services) that is posted on third party websites are included solely as a convenience for those using this site. X Train makes no representations that such information is without errors or omissions. Users of vegasxtrain.com should contact local service providers directly for up-to-date schedule, fare and other information relating to such providers. Unless otherwise stated, X Train is not affiliated with any local service providers.

Shuttle

Shuttle service is complimentary for all VIP & first class riders. Vehicles are generally 24-32 passenger and can make up to 4 stops. Coach and premium coach can add a round trip shuttle transfer for $19.00.

Disclaimer of Liability

X Train’s fares, time schedules, equipment, routing, services and information (hereinafter “X Train services”) are not guaranteed and are provided “as is” without any warranties of any kind, either express or implied, and X Train disclaims all warranties, express or implied. Applicable law may not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

X Train reserves the right to change its policies without notice.

X Train further specifically disclaims liability for any inconvenience, expense, or damages, incidental, consequential, punitive, lost profits, loss business or otherwise, resulting from errors in its timetable, shortages of equipment, or due to delayed trains.

XTrain also disclaims any liability for the products and/or services of X Train’s advertisers, business partners, sponsors, suppliers, licensors and agents to the extent permissible under the law and Amtrak shall only be responsible for the rail transportation services that it provides.

WiFi Onboard

To ensure our passengers remain connected while traveling, X Train offers basic Wi-Fi service in select stations and trains throughout the country. Stay productive, or simply sit back and have some fun while en route to your destination.

X Train Wi-Fi

Delivered free of charge, this basic Wi-Fi service supports general web browsing activities. Due to limited bandwidth onboard the trains, our Wi-Fi does not support high-bandwidth actions such as streaming music, streaming video or downloading large files.

Other Wi-Fi Networks

During your travels you will encounter unofficial Wi-Fi networks located in select stations that are operated and managed by carriers other than X Train. For information on how to connect to these networks and their terms of use, please refer to personnel or collateral located inside these stations.

Thruways & Other Services

While traveling on various connecting transportation services such as Thruways and other services, you will encounter unofficial Wi-Fi networks that are operated and managed by carriers other than X Train. For information on how to connect to these networks and their terms of use, please refer to the operator of that service.

Passenger Identification

Government issued valid photo identification required. X Train customers 18 years of age and older must produce valid photo identification when:

 

  • Obtaining, exchanging or refunding tickets
  • Storing baggage at stations
  • Checking baggage
  • On board trains, in response to a request by an X Train employee

What is a Valid ID?

To be valid, your identification must be current and in-force. The following forms of identification are acceptable for persons 18 and older:

  • One piece of photo identification issued by a government authority, or
  • Two pieces of identification, at least one of which is issued by a government authority

Examples of acceptable forms of ID include:

  • State or provincial driver’s license
  • Passport
  • Official government-issued identification (federal, state, city or county government or foreign government)
  • Canadian provincial health card ID card with photo
  • Military photo ID
  • Student identification (university, college or high school photo ID)
  • Job Corps photo ID

Personal Safety

Onboard Safety

While onboard any X Train car please note the following for a safer and more enjoyable trip.

  • Use seat backs and handrails while walking through the train.
  • Watch your step when boarding and leaving the train.
  • Watch your step moving from car to car while the train is in motion.
  • Be sure to step over the gap between the train and platform.
  • Leave personal food items and baggage at your seat.
  • Wear shoes at all times and use caution when wearing shoes without rubber soles.
  • Never attempt to board or exit a moving train.

Safety at the Station

While at any of our stations please note the following for a safer more enjoyable trip:

  • Arrive at least 1 hour before your train is due to depart. Some stations require more time.
  • Check-in early to arrange for pre-boarding if you need extra time or assistance.
  • Watch your step on station stairs, escalators and train platforms.
  • Stand back from the edge of the platform.
  • Be careful when crossing the gap between the train and platform.
  • Only use authorized X Train attendant for assistance.

Cancellations & Late Check-Ins

  • All reservations must be prepaid with credit card or gift certificate number. We require a credit card to secure a reservation, regardless of whether the reservation is made online or over the phone. The X Train will charge the card provided as soon as we receive the reservation and have confirmed that space is available. It may take up to 24 hours for this charge to reach your account.
  • X Train is unable to offer refunds after a ticket has been purchased; however, a refund may be issued when an event is canceled.
  • If an event is canceled, a refund in the amount of the face value of the ticket will be issued to customers who purchased tickets. Service, delivery and transaction fees will not be refunded.
  • “No show” guests will not be entitled to a refund.
  • We cannot hold the train for any late check-ins due to track rights and times. If you miss the train due to late arrival, that is considered a no show and no refunds will be issued.

Print at Home Tickets

  • Print ticket(s) before arriving and proceed directly to boarding area.
  • Each passenger must present a ticket and valid photo ID to board the train.
  • Tickets are nontransferable. If presented for transportation by any person other than the person who originally purchased, the ticket will be void and may be confiscated.
  • If a passenger has chosen to receive a Print at Home ticket, it is solely the passenger’s responsibility to print the ticket in advance of travel
  • Each passenger must have a separate travel document and each trip must have a separate travel document. Do not print multiple tickets on one page or on the back of a page.

Travel

Departure dates and times may change. X Train is not responsible for delays caused by breakdowns, road conditions, weather or other conditions beyond X Train’s reasonable control.

Baggage

Each passenger may bring two personal items, 25 lbs. (12 kg) and 14 x 11 x 7 inches each, and two carry-on items, 50 lbs. (23 kg) and 28 x 22 x 14 inches each, onboard. Make sure you have a tag with your name and address on the outside of all your bags.

Infant Items
Passengers traveling with infants under the age of two may bring an additional infant item onboard (strollers, diaper bags), which does not count towards the carry-on baggage or personal item limit.
Storing Items

Carry-on and personal items must be kept with you, stored in overhead racks, under seats or designated baggage areas. Do not store your items in empty seats, aisles, vestibules or other areas where they may cause annoyance to other passengers or present a safety hazard.

Smoking is Prohibited

Responsible Consumption of Alcohol

  • The X Train promotes the responsible consumption of alcohol.
  • Valid government issued photo ID must be shown to purchase alcohol.
  • No one under 21 permitted to consume alcohol.
  • Our servers are trained to assist the customer and may refuse to continue to serve alcohol at their discretion.
  • The X Train always reserves the right to withhold service to anyone at any time.
